Agreement to Terms

By accessing or using Smart AI Employee, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use our service.

Description of Service

Smart AI Employee is a customer relationship management (CRM) platform that helps businesses manage contacts, send emails, and process payments. Our platform provides tools to streamline your customer interactions and business operations.

User Accounts

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity that occurs under your account
  • Be at least 18 years of age

Acceptable Use

You agree not to use Smart AI Employee to:

  • Send spam or unsolicited bulk email
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or harmful code
  • Attempt unauthorized access to our systems or other users' accounts

Gmail Integration

By connecting your Gmail account to Smart AI Employee, you:

  • Authorize us to send emails on your behalf when you initiate sending
  • Agree to comply with Google's Terms of Service and Acceptable Use Policies
  • Acknowledge that you are responsible for the content of emails you send
  • Understand that emails sent through our platform will appear in your Gmail Sent folder

You retain full control of your Gmail account and can disconnect at any time.

Rate Limits

Gmail imposes daily sending limits (500/day for free Gmail, 2,000/day for Workspace). These limits are enforced by Google, not Smart AI Employee.

Anti-Spam Compliance

You agree not to use our email features to send spam or unsolicited bulk email. You must comply with CAN-SPAM, GDPR, and other applicable email regulations. Violation may result in account termination.

Payment Terms

If you subscribe to a paid plan:

  • Subscription fees are billed according to your selected billing cycle
  • Payments are processed through Stripe
  • Refunds are handled according to Stripe's terms and our refund policy
  • We may change pricing with reasonable notice to existing subscribers

Intellectual Property

The Smart AI Employee platform, including all software, designs, and content, is our property and is protected by intellectual property laws. Your content remains your property. By using our service, you grant us a license to host and display your content as necessary to provide the service.

Limitation of Liability

The service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the fees you have paid to us in the twelve months preceding the claim.

Termination

We may terminate or suspend your account for violations of these Terms of Service. You may cancel your account at any time. Upon termination, your right to access the service ceases immediately, and your data may be deleted according to our data retention policy.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Maryland, USA, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on this page. Your continued use of the service after such modifications constitutes your acceptance of the updated terms.
